End User License Agreement

This End User License Agreement ("Agreement") governs your installation and use of Vigilante AV ("Software"), provided by Scalewidth Private Limited ("Scalewidth", "we", "us", or "Licensor").

By installing, accessing, or using the Software, you agree to be bound by this Agreement. If you do not agree to these terms, do not install or use the Software.

If you are accepting this Agreement on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

Subject to your compliance with this Agreement, Scalewidth grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software for its intended purposes.

The license is granted for personal or internal business use, subject to any additional licensing conditions applicable to the particular edition or distribution.

This license does not transfer ownership of the Software or any intellectual property rights to you.

Vigilante AV is a Windows security application developed and distributed by Scalewidth.

The Microsoft Store edition may provide a different feature set from other distributions of Vigilante. Features, security components, services, scanning capabilities, and management functionality may vary depending on the package and edition installed.

You should rely on the functionality actually made available in your installed edition.

Scalewidth does not represent that every feature available in other Vigilante distributions is included in the Microsoft Store edition.

You must not, except where applicable law expressly permits:

Nothing in this section restricts activities that cannot legally be restricted under applicable law.

The Software, including its source code, object code, architecture, design, interfaces, documentation, branding, logos, and related materials, is owned by or licensed to Scalewidth.

All rights not expressly granted under this Agreement are reserved by Scalewidth and its licensors.

Vigilante and associated product branding are trademarks or trade names of Scalewidth, where applicable.

No ownership or intellectual property rights are transferred to you through installation or use of the Software.

Scalewidth may release patches, updates, improvements, security fixes, or new versions of the Software.

Updates may be distributed through the Microsoft Store or other authorised distribution channels, depending on the edition.

Some updates may modify, add, or remove functionality. Continued availability of a particular feature is not guaranteed unless separately agreed in writing.

You are responsible for maintaining a compatible operating system and installing updates made available for your edition.

Vigilante AV is designed to assist with endpoint security and protection.

No security application can guarantee the prevention, identification, or removal of every malicious file, vulnerability, attack, or security incident.

The effectiveness of security functionality may depend on operating system configuration, available updates, permissions, connectivity, system compatibility, and the features included in the installed edition.

You remain responsible for maintaining appropriate backups, operating system updates, security controls, and other safeguards.

The Software should not be treated as a guarantee against data loss, unauthorised access, malware infection, or other security incidents.

Your use of the Software is also subject to Scalewidth's applicable Privacy Policy.

The Privacy Policy describes the information that may be collected or processed, the purposes of processing, retention practices, and applicable privacy rights.

The Software's actual data collection and processing depend on the installed edition and the features you use.

This Agreement does not replace the Privacy Policy or any separate consent required by applicable privacy legislation.

The Software may include or interact with third-party software, libraries, frameworks, or services.

Such components may be governed by separate license terms. Where applicable, those terms continue to apply to the relevant third-party components.

Nothing in this Agreement overrides the rights granted under an applicable open-source or third-party license.

To the maximum extent permitted by applicable law, the Software is provided on an "AS IS" and "AS AVAILABLE" basis.

Scalewidth disclaims warranties that are not expressly provided in this Agreement, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent such exclusions are legally permitted.

Scalewidth does not warrant that the Software will operate without interruption or error, that all defects will be corrected, or that all security threats will be detected.

Nothing in this Agreement excludes or limits any warranty or consumer right that cannot legally be excluded or limited.

To the maximum extent permitted by applicable law, Scalewidth shall not be liable for indirect, incidental, special, exemplary, or consequential damages, including loss of profits, loss of business opportunities, loss of data, business interruption, or loss arising from security incidents.

To the extent permitted by applicable law, Scalewidth's total aggregate liability arising out of or relating to the Software or this Agreement shall not exceed the amount paid by you specifically for the Software during the twelve months preceding the event giving rise to the claim.

Where the Software is provided without charge, this limitation shall apply subject to any minimum liability or remedies required by applicable law.

Nothing in this Agreement excludes liability for fraud, wilful misconduct, gross negligence where such exclusion is prohibited, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited.

This Agreement remains effective while you use the Software.

Your license may terminate if you materially breach this Agreement and fail to remedy the breach where a reasonable opportunity to do so is required by applicable law.

Upon termination, you must stop using the Software and uninstall it from devices under your control.

Termination does not affect rights or obligations that by their nature are intended to survive termination, including intellectual property, disclaimers, liability limitations, and dispute-resolution provisions.

Scalewidth may update this Agreement to reflect changes in the Software, applicable law, or business practices.

Material changes will be communicated through an appropriate channel where required by applicable law.

Your continued use of the Software after an updated Agreement becomes effective constitutes acceptance only to the extent permitted by applicable law. Where renewed consent is legally required, it will be obtained separately.

This Agreement shall be governed by the laws of India, subject to mandatory consumer protection and other applicable laws in the jurisdiction where you reside.

Any dispute shall be submitted to the competent courts having jurisdiction under applicable law.

Nothing in this section deprives consumers of mandatory rights or protections available under the laws of their country or place of residence.

If any provision of this Agreement is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in effect.

This Agreement constitutes the agreement between you and Scalewidth concerning the licensing and use of the Software, unless a separate written agreement applies.

If a separate enterprise, commercial, or subscription agreement governs your use of a particular edition, that agreement shall prevail to the extent of any inconsistency.
